These Terms of Service (“Terms”) govern your access to and use of FrenzyGo.com and related services (the “Platform”), operated by Frenzy Brands Inc. (“FrenzyGo,” “we,” “us,” or “our”). By accessing or using the Platform, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Platform.
FrenzyGo is a hyperlocal online marketplace that connects buyers with independent home-based and local sellers in their area. Sellers may offer homemade low-risk foods, baked goods, snacks, pantry items, and similar products subject to our guidelines and applicable law.
FrenzyGo is a platform only. We facilitate listings, discovery, messaging, checkout, and payment processing. We are not the seller of record for items listed by independent sellers, and we do not prepare, package, store, or deliver products ourselves unless explicitly stated otherwise. Each sale is a transaction between the buyer and the seller.
You must be at least 18 years old and able to enter a binding contract to use the Platform. By using FrenzyGo, you represent that you meet this requirement and that all information you provide is accurate and current.
Listings are shown based on your location, a seller’s service radius, store hours, inventory, and listing settings. Availability displayed on the Platform does not guarantee that a seller can fulfill every order or request.
For standard cart checkout, you pay at the time of checkout through Stripe. Your order is placed with the seller for pickup or delivery according to the options presented at checkout.
Some listings use a request flow. In that case, you may authorize payment at checkout, but the seller must accept the request and confirm fulfillment details before payment is captured. If a request is declined, withdrawn, or cancelled before capture, you will not be charged for that request.
Sellers choose whether they offer pickup, delivery, or both. Pickup times, delivery windows, fees, and instructions are set by the seller and shown during checkout or request scheduling. You are responsible for being available at the agreed time and location, and for providing accurate delivery details.
Where available, guests may checkout by providing an email address and delivery details. Guest orders are subject to the same fulfillment and refund rules as registered buyer orders.
Sellers must apply for a seller account, connect Stripe for payouts, and comply with our Seller Agreement and Low-Risk Food Guidelines. Seller-specific obligations, fees, and compliance requirements are set out in the Seller Agreement, which is incorporated into these Terms by reference.
Payments are processed by Stripe. Seller payouts are sent to sellers’ connected Stripe accounts according to Stripe’s payout schedule and verification requirements. FrenzyGo does not store full payment card numbers.
You agree not to:
Many sellers operate from home kitchens or prepare low-risk cottage foods. Product quality, ingredients, allergens, labeling, and legal compliance are the seller’s responsibility. FrenzyGo does not inspect home kitchens and does not guarantee that any product is safe, suitable, or permitted in your jurisdiction.
If you have allergies, dietary restrictions, or food safety concerns, contact the seller before ordering and use your own judgment. Read our Low-Risk Food Guidelines and confirm local public health rules before selling or buying homemade food.
Refund and cancellation rules are described in our Refund Policy. Because many items are perishable, handmade, or fulfilled locally, refund eligibility may differ from traditional e-commerce return policies.
You are responsible for content you submit, including product photos, descriptions, reviews, and messages. You grant FrenzyGo a non-exclusive, worldwide, royalty-free license to use, host, reproduce, and display that content for the purpose of operating and promoting the Platform. You represent that you have the rights needed to submit such content.
The Platform, including its design, software, branding, and content provided by FrenzyGo, is owned by Frenzy Brands Inc. or its licensors. You may not copy, modify, distribute, or reverse engineer the Platform except as permitted by law or with our written consent.
THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, FRENZYGO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED, ERROR-FREE, OR SECURE OPERATION.
FrenzyGo acts solely as a marketplace facilitator. We are not responsible for seller conduct, product quality, foodborne illness, delivery delays, failed pickups, pricing errors, or disputes between buyers and sellers except as required by law.
TO THE FULLEST EXTENT PERMITTED BY LAW, FRENZY BRANDS INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO FRENZYGO IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) CAD $100.
You agree to indemnify and hold harmless Frenzy Brands Inc., its officers, directors, employees, and affiliates from claims, damages, losses, and expenses arising out of your use of the Platform, your listings, your products, your breach of these Terms, or disputes with other users.
You may stop using the Platform at any time. We may suspend or terminate access immediately if we believe you have violated these Terms, created risk for other users, or if required by law. Sections that by their nature should survive termination will continue to apply.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the courts located in Toronto, Ontario for disputes arising from these Terms or the Platform, except where applicable law provides otherwise.
We may update these Terms from time to time. When we do, we will revise the effective date above. Material changes may also be communicated through the Platform. Continued use after changes take effect constitutes acceptance of the updated Terms.
